Plain English Summary

These are the rules of the road between us and you. When you sign up for a plan, attend a class, or use our website, you're agreeing to these terms. We've tried to write them in plain language so you can actually read them. If anything is unclear, email hello@amazingdanceacademy.com and we'll explain.


1. Who We Are

These Terms of Service ("Terms") form a legal agreement between Amazing Dance Academy ("the Academy", "we", "us") and you ("you", "the Member", "the User").

By signing up for a plan, attending a class, or using our website, you confirm you have read, understood, and agreed to these Terms.

2. Who Can Join

To become a member, you must:

  • Be at least 18 years old
  • Provide accurate, current information about yourself
  • Have the legal capacity to enter into this agreement
  • Be able to pay the fees for your chosen plan

We may decline any application at our discretion, particularly if we have reason to believe the membership would not be a good fit for our community.

3. Our Plans and Pricing

3.1 Current plans

We offer a range of membership plans. Current options and prices are displayed on our website at amazingdanceacademy.com/pricing. Plans currently include drop-in classes, monthly subscriptions, and premium memberships.

3.2 Price changes

We may change our prices from time to time. If we change the price of your current plan, we will give you at least 30 days' notice before the new price applies to you. You can cancel before the new price takes effect if you don't want to continue.

3.3 Promotions and discount codes

We sometimes offer promotional codes, complimentary memberships, or referral discounts. These are offered at our discretion and subject to specific terms communicated when the offer is made.

4. Payment

4.1 How payment works

Currently, payments are processed manually via mobile money (MTN, Airtel Money, or other accepted methods). When you sign up:

  1. You select a plan
  2. You receive a unique payment reference code
  3. You send the payment via mobile money to the number we provide, including your reference code
  4. Our staff confirm receipt and activate your account, usually within 24 hours
  5. You receive a confirmation email with your QR membership card

4.2 What happens if payment doesn't go through

If payment is not received within 7 days of sign-up, your pending registration will be cancelled and the payment reference expires. You can sign up again at any time.

4.3 Future payment methods

We may add automated payment options (card, recurring mobile money) in the future. When we do, you will be able to choose whether to opt in.

5. Membership and Access

5.1 Your QR membership card

Active members receive a unique QR code. You must:

  • Present it (on your phone or printed) at each class
  • Not share it with anyone — your QR is tied to your specific account
  • Inform us immediately if you suspect someone else is using your account

Members caught sharing accounts will have their membership suspended without refund.

5.2 Class booking and availability

Some classes have capacity limits. Where booking is required, we will tell you in advance. We aim to run all scheduled classes, but we reserve the right to cancel or reschedule when necessary (instructor illness, low attendance, force majeure).

If we cancel a class:

  • You are not charged for that class if you pay per class
  • Monthly members are not refunded for individual cancelled classes, but we will make reasonable efforts to compensate (additional class credits, replacement classes, etc.)

5.3 Your conduct

Membership is conditional on adhering to our Code of Conduct (a separate document available at amazingdanceacademy.com/code-of-conduct). Violations may result in warnings, suspension, or permanent termination of membership without refund.

6. Refunds and Cancellation

6.1 Drop-in classes

Drop-in fees are non-refundable once the class has begun. If you paid for a drop-in and changed your mind before the class, contact us within 24 hours and we will issue a credit for a future class.

6.2 Monthly subscriptions

Your right to a full refund: You may request a full refund within 7 days of your first-ever payment, provided you have not attended more than one class. This is your "try it out" guarantee.

After 7 days or more than one class: Monthly subscriptions are non-refundable, but we may pro-rate or credit you in exceptional circumstances (medical emergency, relocation, etc.) at our reasonable discretion.

6.3 Cancellation

You may cancel your monthly subscription at any time by:

Your access continues until the end of the period you have already paid for. No refund is given for the unused portion of an already-paid month, but you can keep attending until your access expires.

6.4 Pause / freeze

You may request to pause your membership for up to 30 days at a time, up to twice per year, for reasons such as travel or illness. Submit pause requests to hello@amazingdanceacademy.com at least 7 days before the requested start date.

7. Suspension or Termination by Us

We may suspend or terminate your membership without refund if:

  • You breach our Code of Conduct
  • You behave in a way that endangers other members, staff, or instructors
  • You provide false information at sign-up
  • You misuse our facilities, equipment, or systems
  • You harass, intimidate, or harm another member
  • You commit any criminal act on our premises or at our events
  • You fail to pay outstanding fees

In serious cases (e.g. assault, harassment), we may also report the incident to the relevant authorities.

8. Festival Tickets

The Amazing Festival (the VickFalls Experience) operates under separate ticketing terms, which will be published alongside ticket sales. In general:

  • Festival tickets are separate from membership
  • Festival ticket refund and transfer policies will be communicated at the time of sale
  • Members may receive early-access or discounted ticket offers as part of their plan

9. Photography and Recording

By attending classes, socials, or festival events, you acknowledge that we may photograph or record the event for marketing purposes. You may opt out by speaking to a staff member or the photographer.

Specific rules on photography by members:

  • You may take photos and videos for personal use
  • You may not photograph or record other members without their consent
  • You may not publish photos of other members on social media without their consent
  • Photography by members is not permitted during ticketed classes without instructor permission

10. Intellectual Property

10.1 Our content

All content on our website, social media, marketing materials, and class materials — including logos, branding, photos, videos, written content, and choreography — belongs to Amazing Dance Academy or our licensors. You may not copy, reproduce, or commercially use our content without written permission.

You may share our public social media posts and tag us — that's always welcome.

10.2 Your content

If you submit photos, videos, testimonials, or other content to us (e.g. via our website, social media tags, or in person), you grant us a non-exclusive, royalty-free licence to use it for marketing purposes — with credit where appropriate. You can withdraw this licence by contacting us; we will stop using the content within 30 days.

11. Our AI Assistant Chimwemwe

Chimwemwe is our AI-powered assistant available on our website and (soon) on WhatsApp. While she is helpful and knowledgeable, please note:

  • She is an AI, not a human — she will tell you this if you ask sincerely
  • For complex or sensitive matters (refunds, complaints, accommodations), human staff will follow up
  • Conversations with Chimwemwe are logged and may be reviewed for quality improvement
  • We aim for her to be accurate, but we cannot guarantee zero mistakes — for binding commitments (prices, schedules, policies), the official source is our website and email confirmations

12. Limitation of Liability

12.1 Inherent risks of dance

Partner dance involves physical movement and contact between people. There is a degree of inherent physical risk, including but not limited to muscle strain, slip and fall injuries, ankle twists, and bumps with other dancers. By participating, you accept these risks.

12.2 Our liability

We take reasonable care to provide a safe environment. We are not liable for:

  • Injuries sustained through normal participation in dance, where we have not been negligent
  • Loss or damage to your personal property on our premises (please don't leave valuables unattended)
  • Indirect, consequential, or speculative losses

Nothing in these Terms excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be limited by Zambian law

12.3 Your health

You confirm that you are physically capable of participating in dance classes. If you have a medical condition that could affect your participation (heart conditions, pregnancy, recent injuries), we strongly recommend consulting your doctor first and informing your instructor. You may attend at your own risk.

13. Force Majeure

We are not responsible for failures to deliver services due to events outside our reasonable control — including but not limited to: natural disasters, pandemics, government action, electrical outages, civil unrest, or venue closures. We will make reasonable efforts to reschedule or compensate affected members.

14. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will:

  • Email all active members at least 14 days before the changes take effect
  • Post the updated Terms on our website with a new "Last updated" date

Continued use of our services after the effective date means you accept the updated Terms. If you do not accept the changes, you may cancel your membership and receive a pro-rated refund for any unused full month.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Zambia.

We hope it never comes to this, but if you have a dispute with us:

  1. First, talk to us. Email hello@amazingdanceacademy.com — most issues are resolved within a few days.
  2. Mediation. If we can't resolve it directly, we both agree to attempt mediation through a mutually agreed mediator before any legal proceedings.
  3. Courts. If mediation fails, the courts of Zambia have exclusive jurisdiction.

16. Severability

If any part of these Terms is found to be unenforceable, the rest remains in force.

17. Entire Agreement

These Terms (together with our Privacy Policy, Code of Conduct, and Refund Policy) form the complete agreement between you and Amazing Dance Academy regarding your membership. They replace any previous agreements or representations.
